Filing False Tax Return Can Be Aggravated Felony Under INA |

On April 5, 2008, the Fifth Circuit Court of Appeals held that "knowingly filing a a false tax return in violation of 26 USC §7206(1) is an aggravated felony under INA §101(a)(43)(M)(i) if the loss to the government exceeds $10,000." The case, Arguelles-Olivares v. Mukasey , means that the Fifth Circuit has expanded the definition of criminal tax offenses which are considered aggravated felonies. The court's holding affirmed the Board of Immigration Appeals and ordered the Respondent, a legal permanent resident, removed from the United States. |

USCIS Issues New Employment Authorization Form I-765 |

U.S. Citizenship and Immigration Services (USCIS) has released a new Form I-765, Application for Employment Authorization. Previous versions of Form I-765 will be accepted until July 8, 2008, but thereafter USCIS will reject the old forms. The main purpose of Form I-765 is to allow certain aliens in the United States to request employment authorization and an Employment Authorization Document. Make sure you use the new form!
